PAYMENT
FOR JURY DUTY: PURSUANT
TO LAW: Jurors will be paid $40.00 for each day of attendance with
the following exceptions: 1)
No payment
is made to jurors who are employed and receive their regular wages from
their employer during their term of service. 2)
No payment
is made to jurors if they are employed by an employer that employs more
than ten (10) employees (including both full-time and part-time
employees) for the first three (3) days of jury service who do not pay
their regular wages. Such
employers are prohibited by law from withholding the first $40.00 of daily
wages during the first three (3) days of jury service, which means the
employer must pay the employee $40.00 per day for three days.
After three days, jurors will be paid the $40.00 per diem payment
by the NYS Office of Court Administration.
If an employee does not earn a total of $40.00 per day they will be
paid the difference between the employee’s daily wages and the
$40.00 per diem fee during the three day period. 3)
If you report
for jury duty on your regular day off, you will be paid the
jury per diem payment. 4)
If you are
employed by someone that does not employ more than 10 employees (this
includes part-time and full-time employees) and your employer does not pay
your regular wages, you will receive the $40.00 jury payment. All other jurors i.e. unemployed, retired, disabled, on compensation, employed by an out-of-state employer who does not pay regular wages, self-employed, will be paid the per diem fee mentioned above.
